Online services, automatic bookings, and the documents that govern each inspection.

1. Scope, acceptance, and document priority

These Website Terms & Conditions (Terms) govern use of MultiView Inspections, LLC’s (MVI) public website, related subdomains, booking tools, client portal, forms, payment pages, and online content (Site). MVI provides inspection services in the Permian Basin. A person making a booking, creating an account, or entering a service agreement must be at least 18 and legally capable of contracting. A representative must have authority for the action taken.

MVI presents these Terms for review with the applicable online acceptance process and records affirmative acceptance where required. Ordinary browsing does not sign a Pre-Inspection Agreement or authorize a charge, text messages, or sensitive-data processing that requires separate consent.

Inspection services are governed by the signed Pre-Inspection Agreement, accepted service order, and MVI’s Cancellation, Rescheduling & Refund Policy, version 2026-09-13-R3 supplied before acceptance. The service order states scope, dates, and fees. The signed agreement controls service conflicts. No MVI document may increase the appointment-fee cap stated below. The Privacy Policy governs MVI’s handling of personal information. Website Terms & Conditions govern website and portal use and do not add inspection fees or replace service obligations. A third-party provider’s terms govern only that provider’s benefit. Mandatory law and rights that cannot lawfully be waived control throughout.

2. Service descriptions and inspection scope

General Site content describes services and technology; the selected package and accepted service order identify what is included. Not every tool or listed deliverable is included in every inspection. Availability depends on the selected scope, property, access, safety, weather, equipment, and legal requirements. These limitations do not erase an expressly included service or benefit.

A full home inspection is a limited visual survey and basic performance evaluation of accessible systems using normal controls, subject to applicable TREC requirements. It is not technically exhaustive, a code-compliance certification, engineering analysis, appraisal, insurance policy, or guarantee of property condition. Limited and construction-phase services cover their agreed scope. Mandatory standards and promised supplemental services remain applicable.

General articles, sample reports, images, and educational material are not an opinion about a particular property or a substitute for a property-specific inspection or appropriate professional advice. They do not direct a purchase, sale, repair, insurance, or financial decision.

3. Automatic appointment confirmation

Appointments booked through MVI’s online scheduling system are automatically confirmed when the completed booking generates a confirmation. No separate MVI approval is required. A quote, inquiry, incomplete submission, or unconfirmed time selection does not reserve an appointment.

Automatic confirmation reserves the appointment; payment is not required to confirm it. The required Pre-Inspection Agreement must still be signed, payment in full must be received, and lawful access must be available before inspection work begins, unless MVI agrees to a different payment schedule in writing.

A confirmed appointment is held while the required Pre-Inspection Agreement is signed. If it is not signed within two hours of the time the appointment was booked or last rescheduled, or by twelve hours before the scheduled start time if that is sooner, MVI may release the appointment and return the time to its available schedule. MVI will notify the Client at the email address given at booking before releasing the time. A release under this paragraph is a cancellation by MVI: no cancellation, rescheduling, missed-appointment, or trip fee applies, no amount is charged, and any prepayment is refunded in full. The Client may book again at any time, subject to availability. The Cancellation, Rescheduling & Refund Policy states the full terms, including the minimum holding period and the treatment of appointments MVI enters at a Client’s request.

An appointment entered by MVI at a Client’s request is confirmed when its scheduling system issues confirmation. Clients should check the property, selected scope, date, time, price, and contact details promptly. Choosing SMS is optional and has no effect on confirmation.

MVI may correct a genuine booking error or postpone or cancel work that is outside its service area or qualifications, unlawful, unsafe, inaccessible, or prevented by missing agreements or payment. MVI will notify the Client and apply the accepted cancellation and refund terms. This is not a separate approval requirement.

4. Pricing, payment, and changes

Prices may depend on size, age, property type, travel, selected services, structures, visits, and disclosed conditions. General starting prices and estimates are not final property-specific quotes. MVI will disclose the agreed price, allocations, and applicable charges before acceptance. Scope or fee changes require the Client’s written acceptance before additional work; a later invoice alone does not impose a new term.

Payment is not required when booking, but payment in full is due before inspection work begins unless another schedule is agreed in writing. Automatic confirmation does not defer that deadline. If MVI performs services before payment, report delivery remains governed by the signed agreement and applicable TREC requirements.

Payment processors handle transactions under their applicable terms. These Terms do not authorize an additional stored-payment charge, waive lawful chargeback rights, or excuse MVI’s own legal duties. Future price changes do not retroactively alter an accepted price.

5. Cancellation, rescheduling, and refunds

MVI’s Cancellation, Rescheduling & Refund Policy, version 2026-09-13-R3 is provided before booking and payment and applies when affirmatively accepted. At least 24 hours’ notice, including exactly 24 hours, permits cancellation or rescheduling without an appointment fee. Late changes or a readiness failure before work begins may result in one fee under that policy.

Only one cancellation, late-rescheduling, missed-appointment, or trip fee may apply to the same affected appointment. The total of all such charges, including any applicable tax, will not exceed the lesser of $150 or the agreed price of that appointment. No additional travel, preparation, processing, administrative, or third-party cancellation charge may be added for the same event. MVI may reduce or waive the fee.

No appointment fee is added after inspection work begins; only a reasonable, documented earned portion of the agreed service price may be retained. No appointment or extra completion-visit fee applies to qualifying weather, airspace, regional utility, safety, or MVI operational postponements. MVI refunds unearned amounts for unperformed services unless the Client accepts another arrangement. Processing and unrecovered third-party costs for unperformed services are absorbed by MVI.

Refund determinations are provided within five business days of the request or necessary missing information, and determined refunds are initiated within three business days. Undisputed refunds are not held because another amount is disputed. The full policy explains calculation, exceptions, original-payment refunds, bank posting time, and notice receipt. Requests may be made through a supplied scheduling or portal function, email, or telephone with a clear voicemail if unanswered.

6. Access information and authority

The Client or authorized scheduler must provide accurate property, contact, occupancy, access, and service information and arrange lawful entry. An address, lockbox code, agent’s name, or third-party payment does not establish authority to sign for the Client or receive the Report. MVI may request clarification and may refuse unsafe or unauthorized access.

7. Reports and permitted sharing

The signed inspection agreement governs report delivery, ownership, use, corrections, and retention. Reports describe observed conditions at the inspection time. MVI retains copyright in original content; the Client may retain and use the Report for the selected service’s purpose, including purchase or sale decisions, ownership, maintenance, repair planning, insurance or warranty claims, advice, and legal rights.

The Client may share the Report with agents, lenders, insurers, attorneys, contractors, specialists, other advisors, courts, and regulators for those purposes. Sharing does not create an independent inspection duty or reliance right for another person, except by written agreement or law. Reports must not be misleadingly altered, sold, rebranded, or presented as current inspections for later transactions.

Download and retain needed copies from the MVI client portal. Online access is not guaranteed indefinitely. Contact MVI for an available retained copy if portal access is interrupted; access restrictions do not eliminate required delivery or records-access duties.

8. Technology and measurement limitations

Cameras, thermal imaging, drones, relative-elevation and grading tools, 360-degree imagery, and measurement or analysis software support the agreed inspection. They do not remove access, calibration, environmental, equipment, software, data-quality, or human-judgment limitations.

Thermal imagery shows surface-temperature patterns and does not independently confirm a concealed defect or its cause. Drone operations depend on lawful airspace, weather, safety, and the remote pilot’s judgment. Approximate measurements, floor plans, and diagrams are not engineering, surveying, architectural, boundary, construction, permitting, or exact-area certifications. An unavailable expressly purchased deliverable is subject to the accepted service and refund terms.

9. Third-party Buy-Back and warranty benefits

The InterNACHI® Buy-Back Program and InterNACHI® Inspection Warranty Pro Plan are separate benefits when included in the selected service. Buy-Back concerns an eligible home purchase by InterNACHI; the warranty concerns eligible repair reimbursement under its provider terms. An 11-month builder-warranty inspection is a separate inspection service.

MVI will provide the written terms applicable to the selected benefit, identify the responsible provider through those documents, and complete enrollment required of MVI. Eligibility, limits, exclusions, effective periods, claims, and remedies are governed by the terms applicable to the particular enrollment. Later terms apply only as permitted by those terms and law.

MVI does not independently promise to purchase the home or insure its condition. These provisions do not reduce an included benefit, excuse a misleading representation, or eliminate MVI’s own inspection, enrollment, disclosure, or refund obligations. Clients should retain the provider documents and promptly follow the applicable claim process.

10. Accounts, portal security, and availability

Protect passwords, access codes, and private links. Use only accounts and reports you are authorized to access; do not bypass controls, impersonate others, share credentials with unauthorized persons, or disrupt a service. Notify MVI promptly of suspected unauthorized access.

Maintenance, outages, processing delays, and other interruptions may occur. MVI may reasonably restrict access to address misuse or security risks, but will provide another appropriate method for required records or paid deliverables. Contact the office if an urgent service message is not acknowledged.

11. Acceptable use and intellectual property

MVI grants permission to use the Site for lawful personal or business purposes connected with evaluating, arranging, or receiving MVI services. Original Site content and branding belong to MVI or their respective licensors. Third-party marks remain their owners’ property.

Except as permitted by law or written authorization, do not reproduce or commercially exploit Site content, remove ownership notices, falsely imply MVI endorsement, use samples to provide competing services, or collect Site content to train an AI system or operate a commercial database. Ordinary linking and accurate lawful references to MVI are allowed. These restrictions do not narrow permitted client Report use.

Do not submit fraudulent information, violate others’ rights, introduce malware, send spam, attempt unauthorized access, or scrape or harvest protected content or personal data through automated means without authorization. Reasonable security and access restrictions may be imposed for violations.

12. Submissions and communications

Provide information you are authorized to share and reasonably believe accurate. MVI may use submissions as necessary to answer inquiries, provide services, maintain appropriate records, and comply with law, subject to the Privacy Policy. Sending a review, photograph, or suggestion does not transfer ownership or grant unrestricted publicity rights. Public use of identifiable client or property information requires appropriate separate authorization.

13. Optional text messages, calls, and email

MVI offers optional automated service-related text messages about booking confirmations, appointments, access, agreements, payment, inspection updates, report availability, and service follow-up. MVI does not send marketing or promotional text messages under this consent.

The subscriber or customary user of the number must affirmatively opt in through an unchecked option on MVI’s booking form, Pre-Inspection Agreement, or another clearly identified consent form. Providing a number, booking an appointment, signing an agreement, or paying does not by itself authorize texts. A person arranging an inspection for someone else may opt in only for that person’s own number.

Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out or HELP for help, or contact MVI by phone or email. MVI accepts other reasonable opt-out requests and honors them promptly within the period required by law. Opting out of texts does not cancel an appointment, and cancelling an appointment does not by itself withdraw text consent.

MVI may use service-related calls or email consistent with law and the requested service. Any marketing text program requires separate consent. A limited nonpromotional opt-out confirmation may be sent where lawful. Mobile carriers are not liable for delayed or undelivered texts. MVI retains appropriate consent and withdrawal records; the Privacy Policy describes the handling of mobile information.

14. Privacy and third-party services

The Privacy Policy describes collection, use, disclosure, security, retention, and privacy requests. It governs MVI’s information handling; acceptance of these Terms does not replace consent required for a specific processing activity.

MVI uses its own booking and client-portal software and third-party services for functions such as hosting, payments, communications, electronic signatures, storage, mapping, weather, and inspection-media processing. Providers may change. Their independent services have their own terms, but MVI remains responsible for its own legal and contractual duties. A link does not guarantee an independent provider’s performance.

15. Website changes and warranty disclaimer

MVI may update or discontinue Site content, features, or future offerings. For confirmed services, any change to the agreed scope or price requires the acceptance described in the service documents; safety or legal limitations remain subject to their completion and refund provisions.

To the extent permitted by law, the Site and general content are provided as available and as is, without a warranty of uninterrupted access, completeness, error-free operation, security, merchantability, fitness for a particular purpose, or noninfringement. This website disclaimer does not disclaim an express service promise, an included provider benefit, or a nonwaivable right.

16. Website liability

To the extent permitted by law, MVI is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising solely from website access, interruption, or reliance on general Site content. Inspection or other paid-service liability is governed by the applicable service agreement and law, not this website provision.

This exclusion does not apply to fraud, gross negligence, intentional misconduct, bodily injury or death, required refunds, breach of a nonwaivable privacy or data-security duty, or any liability or remedy that law does not permit the parties to exclude. It does not excuse MVI’s own express contractual duties.

17. Responsibility for third-party claims

To the extent permitted by law, a user will reimburse MVI for reasonable losses, costs, and expenses awarded in a third-party claim to the extent caused by that user’s unlawful Site use, knowing unauthorized access, knowing submission of unauthorized materials, or infringement of another person’s rights. This does not apply to ordinary authorized use, permitted Report sharing, or a good-faith complaint.

MVI must promptly notify the user, allow reasonable participation in the defense, and reasonably mitigate loss. No settlement binds the user without written consent, not to be unreasonably withheld. This provision does not shift liability for MVI’s negligence, breach of contract, fraud, gross negligence, intentional misconduct, or nonwaivable duty.

18. Texas law and disputes

Texas law governs these Terms. A court action must be brought in a court with jurisdiction and a county where venue is proper under Texas law. No nonwaivable venue or procedural right is waived. Disputes concerning paid services follow the applicable inspection agreement. These Terms impose no arbitration requirement or shortened claim deadline.

19. Electronic records, updates, and general terms

MVI may provide records electronically when the user chooses electronic transactions or otherwise consents as required by law. Maintain current contact details and download or print records needed for retention. Contact MVI for assistance accessing a record.

MVI will identify revised Terms by date and version and provide notice and renewed acceptance where required for material changes. Updates govern future use and do not retroactively change an accepted booking, signed agreement, or accrued right. Continued browsing alone does not amend a signed service contract.

If a provision is unenforceable, the remainder continues to the extent lawful. A failure to enforce a term is not a continuing waiver. These Terms and the Privacy Policy address Site use; service documents address the purchased engagement. Neither set eliminates rights that cannot lawfully be waived.
